The petitioners through instant petition under Articles 226/227 of the Constitution of India are seeking direction to respondent No. 2 to issue their passport.

Learned counsel for the petitioners inter alia contends that petitioners are minor and they are staying with their mother. Matrimonial dispute is pending between parents of the petitioners. The petitioners have applied for passport, however, respondent is insisting for consent of father of the petitioners. The mother of the petitioners is ready to appear before respondent and she has already filed Form-C.

Learned counsel for Union of India states that petitioners may be directed to appear before passport authority alongwith their mother and requisite documents. On doing so, passport authority would pass an appropriate order within six weeks.

Learned counsel for the petitioners agrees to the aforesaid arrangement.

In view of statements of both sides, the petition stands disposed of with a direction to petitioners to appear before the passport authority on 19.12.2023 alongwith their mother and requisite documents.
