The aforesaid appeal was filed on 05.12.2019. The Registry had raised objection on the case file. Thereafter, the case was refiled but met with the same fate. Lastly, objection was raised on 24.02.2020. 2.

As per Rule 9, Chapter 1, Part-A, Volume V, Punjab and Haryana High Court Rules and Orders, the petition on which objections have been raised by the Registry is to be taken back by the counsel/ party, who filed it, to be re-filed within a total period of 40 days. In spite of SMS having been sent at the registered mobile, the same was not taken back for re-filing after removal of objections. On failure, the case is to be listed before the Court for orders.

Learned counsel for the appellants submits that inadvertently, two original sets of the same paper-book were filed in the Registry. The other set has been registered and numbered as FAO No.925 of 2020 and is pending for 16.01.2025.
