(ORAL) Challenge in present petition is to the order dated 21.09.2018 (Annexure P-8) whereby representation of petitioner in pursuance of direction issued by this Court for consideration of candidature of petitioner as Disabled Ex-serviceman instead of Ortho Handicapped as he being handicap to the extent of 70% has been decided against the petitioner.

Learned counsel for petitioner submitted that not only examination but entire selection process is over. The impugned order is vexatious and fallacious.

I have heard learned counsel for petitioner, appraised paper book and of the view that reasoning assigned in impugned order do not come within realm of judicial scrutiny of this Court, for, no right can be created for change of category under any statutory provision or executive instruction.
