This is a petition under Section 439 Cr.P.C. seeking regular bail to the petitioner in case FIR No.216 dated 5.4.2022 under Section 10 of POCSO Act, 2012, registered at Police Station Sector 8, Faridabad. 2.
Undisputedly, the petitioner is in custody since 8.4.2022. During trial material witnesses, including the victim as well as her mother, stand examined. There are fourteen witnesses in all, and the trial is fixed for 25.7.2023 for examining the remaining witnesses.

Culpability of the petitioner is a matter of trial, which will take some time to conclude, as eleven prosecution witnesses are still to be examined. Besides, material witnesses already stand examined. Therefore, no useful purpose will be served by confining the petitioner to custody during trial, any longer.
