In the present petition, the challenge is to the selection of respondents No. 4 & 5 on the post of pharmacists on the ground that the selection of the private respondents No. 4 & 5 has been done by giving them additional five marks for which the private respondents are not entitled.

Learned counsel for the petitioner submits that the petitioner has already raised the said grievance in the representation dated 13.05.2022 (Annexure P-7) but the same is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a direction is issued to the respondents to decide the same by passing an appropriate speaking order in a time bound manner. 3.

Notice of motion.

On the asking of the Court, Mr. Harish Nain, AAG, Haryana, who is present in Court, accepts notice on behalf of the respondent-State and submits that in case, the representation dated 13.05.2022 (Annexure P-7) has been received in the office of the concerned authorities and the same is still pending consideration with the authorities concerned, the same will be RIYA 2023.11.29 17:05 I attest to the accuracy and integrity of this document

Before passing any order on the representation, the private respondents No. 4 & 5 be given due opportunity to defend their appointment by supplying representation filed by the petitioner and the appropriate order be passed after taking into consideration the stand taken taken by the petitioner as well as private respondents No 4 & 5 in their defence. 6.

Learned counsel for the petitioner submits that keeping in view the statement of learned State counsel, the present petition may kindly be disposed of having been not pressed any further. 7.
