**** HARSIMRAN SINGH SETHI , J. (ORAL) CM-14082-CWP-2025 This is an application seeking condonation of delay of 40 days in filing the review application.

Heard. For the reasons stated in the application, same is allowed and delay of 40 days in filing the review application is condoned. RA-CW-421-2025 1.

Learned counsel for the review applicant submits that the benefit has been granted from the date of discharge rather than from the date of the review Survey Medical Board according to which the disability of more than 20% was assessed so as to entitle the benefit of disability. Learned counsel submits that the said fact has not been considered by the Division Bench while passing the order dated 03.07.2025.

We have heard learned counsel for the review applicant and have gone through the record with his able assistance.

On being asked whether such argument was raised for the consideration of the Division Bench, the learned counsel very fairly conseded that once, the order was passed based upon the argument raised, subsequently, the review cannot be filed so as to raise another argument which was not raised for the consideration of the Division Bench.

No ground is made out to allow the present application seeking review of order dated 03.07.2025.
