(ORAL) Petitioner herein is one of the defendants in Civil Suit No.2985 of 2017 titled as Bhola Singh and others Vs. Partap Singh and others, pending in the Court of learned Civil Judge (Jr. Division), Amritsar. He is aggrieved by the order dated 12.09.2018 (Annexure P5), whereby his application under Order VII Rule 14 CPC to direct the plaintiffs to place on record the documents relied upon by them, was rejected. 2.
It is contended by learned counsel for the petitioner that in the plaint (Annexure P1), plaintiffs have referred to certain sale deeds, the production of which is necessary for preparation of the written statement by the defendants. However, the application has been rejected by the trial Court by observing that copies of five sale deeds and other documents have been placed on record and that the applicant-defendant did not disclose specifically as to which document had not been filed. Learned counsel submits that petitioner wants the plaintiffs only to produce those documents, which have been referred by them in the plaint.

Nobody has put in appearance on behalf of the respondents though they were duly served.

After hearing learned counsel for the petitioner, this petition is hereby disposed of with a direction to the trial Court to ensure that the copies of the sale deeds/transfer deeds, which are referred by the plaintiffs in the plaint, are produced on file. In case, any other document is sought to be produced by the petitioner-defendant, he will have to specifically mention about the same in his application, for which necessary permission shall be granted to him.
