The present petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeking the relief of anticipatory bail to the petitioner, apprehending his arrest in FIR No.131 dated 08.11.2022, under Sections 363, 366-A IPC, registered at Police Station Arniwala, District Fazilka (Annexure P-1).

However, as per office report, earlier also, petition under Section 482 Bharatiya Nagarik Suraksha Sanhita, 2023, bearing No.CRM-M-29708-2024, has been filed.

Perusal of the order dated 22.07.2024, passed by this Court, indicates that the said first petition was dismissed on merits by observing that the victim was 161⁄2 years old. As per the status report filed by the State, she was 16 years old at the time of the alleged occurrence.

In Para No.15 of the present petition, it has been categorically stated that the petitioner has not filed any such criminal petition either in this Court or in the Hon'ble Supreme Court of India. The present petition is also supported by a duly-sworn affidavit of the petitioner-Arshdeep Singh, which has been attested by the notary public on 16.10.2024.

The petitioner has executed a false affidavit as well as filed the present petition by concealing material facts from this Court. 6.

In view of such circumstances, the petitioner is not entitled to the concession of anticipatory bail. The present petition stands dismissed, subject to payment of cost of Rs.5,000/-, to be deposited with the Punjab State Legal Services Authority. Copy of this order be also sent to the Secretary, Punjab State Legal Services Authority and the trial Court.
