Main case Instant petition has been filed seeking issuance of a writ in the nature of mandamus directing the respondents to grant the benefit of Assured Career Progression (ACP) as per length of service and to decide a representation dated 01.09.2022 (Annexure P-1) which is pending with the official respondents.
Counsel for the petitioner submits that the petitioner was appointed as a Peon on a regular basis on 28.05.1976 and was promoted as a Clerk on 10.12.1982 in the pay scale of Rs. 400-660. He submits that the SUNITA NAGPAL 2023.03.27 18:52 I attest to the accuracy and integrity of this order/judgment
2023:PHHC:044597 CWP-30337-2022(O&M) petitioner retired from service on 30.06.2010 and he has been granted ACP benefit, but he is entitled to the same, from an earlier date. Counsel submits that the petitioner has submitted a representation dated 01.09.2022 (Annexure P-1) but the same has not been attended to. Counsel submits that the petitioner will be satisfied in case a direction is given to the respondents to look into it.

On asking, Mr.Pankaj Middha, Addl. AG, Haryana accepts notice on behalf of the respondents.
Having heard counsel for the parties, but without examining the claim of the petitioner as raised in the writ petition or in the representation, this petition is disposed of with a direction to respondent No.3 to examine the representation Annexure P-1 within a period of four months from the date of communication of a copy of this order. In case respondent No.3 finds that the claim of the petitioner cannot be granted, an order be passed assigning reasons for rejection.
