The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to Director, Rural Development and Panchayat Department, Mohali to take action on inquiry report dated 21.02.2025 submitted by Inquiry Officer with respect to embezzlement and corruption committed by respondent No. 4-Vinod Kumar Joshi. 2.
On 10.12.2025, the following order was passed by this Court:- "
Affidavit of Mr. Kuldeep Singh Sian, Under Secretary, Rural Development and Panchayat Department, Punjab, has been filed on behalf of respondents No.1 to 3, which is taken on record. Copy be supplied to the counsel for the petitioner, who is not available.
By referring to the affidavit, State counsel submits that disciplinary proceedings have been initiated against respondent No.4, and he has been served with chargesheet dated 01.12.2025, Annexure R-1/T, issued PARAMJIT KAUR SAINI 2026.04.27 05:32 I attest to the accuracy and integrity of this document
CWP No.27802-2025(O&M) -2- under Rule 8 of the Punjab Civil Services (Punishment and Appeal) Rules, 1970. He states that the Disability Certificate of respondent No.4 has also been verified and it has been found that he has a disability to the extent of 42% (RSA Ankle Foot left side), Annexure R-2. On written request for deferment, circulated by Mr. Sandeep Kumar, Advocate, counsel for the petitioner, stating that he is out of station, list on 19.03.2026."

Learned State counsel pointing out affidavit dated 08.12.2025 of respondent submits that action against respondent No. 4 on the basis of enquiry report has already been initiated. He has already been served charge sheet for major penalty as per Rule 8 of Punjab Civil Services (Punishment and Appeal) Rules, 1970.

In view of contents of affidavit filed by respondent, no further order is warranted.
