(Oral) Learned counsel for the petitioners submits that after filing of the instant quashing petition, the petitioners have chosen to file a revision petition before the Sessions Court laying challenge to the charges framed against them by the Court of Magistrate.

In this view of the matter, learned counsel for the petitioners seeks to withdraw the instant petition with liberty to pursue the said revision petition pending before the Sessions Court.

Ordered accordingly.

The concerned Sessions Court is directed to take a conscious decision upon the revision petition filed by the petitioners in accordance with law expeditiously preferably within a period of three months from the PARVINDER SINGH 2024.09.04 17:30 I agree to specified portions of this document chandigarh

CRM-M-51099 of 2018 date of receipt/production of certified copy of this order. It is further directed that the personal presence of petitioners No. 1 and 2 shall remain exempted during the course of trial subject to the following conditions :- (i) They will be represented by a counsel;

(ii) They will not delay/stall the proceedings of the trial Court;

(iii) They will not dispute their identity as accused; (iv) They will have no objection if the prosecution evidence is recorded in their absence but in presence of their counsel;

(v) They will appear before the trial Court as and when required by the trial Court and any other condition which the trial Court may impose.

The petitioners shall file affidavits before the concerned trial Court stipulating above conditions.
