**** HARNARESH SINGH GILL, J.(Oral) Prayer in this petition is for issuance of directions to the respondents to transfer the petitioner from Patiala Jail to Amritsar Jail and to protect his life and liberty.

Learned counsel for petitioner submits that the petitioner has been confined in Central Jail, Patiala since 27.03.2019 and that, at the time of filing the present petition (in the year 2019), the petitioner had been continuously receiving threats and was under apprehension that he would be harmed/killed, at the instance of Dilpreet Bawa group. He further submits that, though, owing to the pendency of the present petition, the petitioner has not been harmed till date, yet the fact remains that still there are some threat perceptions. On the other hand, learned State counsel submits that earlier the petitioner was lodged in the jail at Ropar and thereafter, he was AMAN JAIN 2023.07.13 17:31 I attest to the accuracy and integrity of this document

CRM-M-52670-2019 (O&M) -2 transferred to Central Jail at Patiala. He further submits that the petitioner himself is a person of criminal antecedents, inasmuch as, there are 58 more cases registered and/or pending against him (out of the said cases, the petitioner stands acquitted in 15, convicted in 5 and 38 are under trial). Still further, it is submitted that the members of Dilpreet Bawa group are confined in Jail at Amritsar and thus, it will not be possible for the State, to transfer the petitioner to the jail at Amritsar, as sought for in the present petition.

I have heard the learned counsel for the parties. The petitioner has been confined in Patiala jail since 27.03.2019 and no harm has been caused to him till date. The petitioner himself is facing 58 more FIRs, though acquitted in 15 and convicted in

5. Above all, the jail authorities are duty bound to protect the life and liberty of the petitioner.

In view of the above, no further orders are called for. Disposed of.

However, the petitioner would be at liberty to file an application for revival of the present petition or file a fresh petition, if there exists any threat, if so advised.
