**** RITU BAHRI , J. (Oral) Petitioner is seeking issuance of direction to the respondents to fix his pay, in view of order dated 18.12.1995 passed in CWP No. 11351-1995 or in view of instructions dated 27.08.1998 (P-3) and 03.05.2018 (P-9). Petitioner is further praying to grant him benefits of counting military service rendered by him during national emergency for increments, seniority etc along with all consequential benefits.

In this regard, petitioner has given legal notice dated 13.05.2019 (P7) wherein petitioner has sought grant of incremental benefit equal to the number of completed years of service rendered in armed forces. He has referred to memo dated 11.04.1963 and letter dated 27.09.1998. A Division Bench of this Court had allowed the CWP No. 113511995 on 18.12.1995 (P-6) and direction was given to the respondents to decide the case of the petitioner for fixation of pay in terms of office memorandum dated 11.04.1963 (P-4), within a period of three months. Without commenting upon merits of the case, the present petition is
