Learned counsel for the petitioner submits that the petitioner has been issued a charge sheet dated 25.10.2023 (Annexure P-10) alleging certain irregularities for the period starting from January 2014 to June 2016 while being posted at village Kathu Nangal, Block Majitha, District Amritsar.

Learned counsel for the petitioner further submits that the petitioner was not posted as Block Development and Panchayat Officer, Majitha at the relevant point of time, still the petitioner has been issued a charge sheet and in the reply to the said charge sheet, the petitioner has already mentioned the said fact but the respondents are not taking appropriate decision as to whether, the averments made by the petitioner in his reply are valid and the charge sheet is liable to be withdrawn. Learned counsel for the petitioner further submits that the respondents be directed to pass appropriate order keeping in view the reply filed by the petitioner qua the charge sheet dated 25.10.2023, copy of which has been appended as

Annexure P-10.

Ms. Shruti,AAG, Punjab, who is present in Court, accepts notice on behalf of respondents-State.

Learned counsel for the respondents-State submits that the appropriate decision on the charge sheet dated 25.10.2023 (Annexure P-10) will be taken by the competent authority keeping in view the factual averments made by the petitioner in the reply, within a period of eight weeks from the date of the receipt of certified copy of this order by passing an appropriate speaking order and the same will be duly conveyed to the petitioner.

Learned counsel for the petitioner submits that keeping in view the fact that the petitioner has already retired from service and the pensionary benefits of the petitioner have been withheld, hence the respondents be directed to release the pensionary benefits, in case, the respondents finds that the charge sheet issued to the petitioner, due to which the pensionary benefits have been withheld, is to be dropped, and appropriate relief for which the petitioner is entitled for qua the pensionary benefits be released.

Learned State counsel submits that in case the charge sheet is dropped, an appropriate relief for which the petitioner is entitled for qua the pensionary benefits will also be released.

Leaned counsel for the petitioner submits that in view of the statement of learned counsel for the respondents-State, the present petition may kindly be disposed of having been not pressed any further.
