Mr. Harinder Singh Aujla, Advocate, for the petitioner. ***** Rajan Gupta, J. (Oral) Petitioner has impugned the Merit List dated 08.10.2018, (Annexure P-7) whereby respondent No.5 was selected as ASHA Facilitator under the prevalent Scheme. It has been urged before the court that selection has been made arbitrarily. Name of the petitioner was even approved vide letter, Annexure P-5. However, still respondent No.5 was selected.

Learned counsel further submits that certain guidelines have been violated. Petitioner is already working as an ASHA Worker and selection to the post of ASHA Facilitator has to be made from the category ASHA Workers.

I find no ground to interfere as it is evident that the petitioner was duly considered for the post. The plea that the guidelines issued in this regard by the National Rural Health Mission have been violated, is not borne out from the record. Besides, guidelines are purely directory in nature and there can be no conclusion that the selection is arbitrary or was done with a view to favour the private respondent. Accordingly, present petition being without any merit, is hereby dismissed.
