H. S. Madaan, J. (Oral) Since the petitioner has surrendered in the trial Court and has been admitted to bail, the order dated 16.12.2019, granting him interim bail, is made absolute, subject to fulfillment of following conditions:- i) that the petitioner shall appear in the Court on each and every date of hearing.

ii)that the petitioner shall not give any threat or intimidation to the prosecution witnesses.

iii)that the petitioner shall not leave India without the prior BANITA CHUGH 2020.03.05 15:02 I am the author of this document

CRM-M- 52901 of 2019 -2permission of the Court. iv)that the petitioner shall surrender his passport before the Investigating Officer and if he is not having passport then he shall file an affidavit in that regard.

In case the petitioner violates any term and condition on which the bail has been granted to him, the prosecution would be entitled to apply for cancellation of bail.

The petition in that way is allowed.

The trial Court may initiate proceedings under Section 446 Cr.P.C. against the petitioner and his earlier surety and then take suitable action in the matter. The trial court would direct the petitioner to furnish local sureties who are sound having documentary proof of immovable properties within the jurisdiction of such court.
