637 Present writ petition has been filed for directing the respondents to conclude the partition proceeding in case bearing No.67/NT titled as Babu Ram and others vs. Rajbir Singh and others in which the partition proceedings had been initiated in the year 2008 and the same had not been concluded despite passing of almost 15 years of initiation due to the non action on the part of the respondents. Further prayer has been made for directing the respondents to decide the representation dated 26.06.2023 (Annexure P-11) of the petitioner for concluding the partition proceedings by preparing amended Naksha Bey in view of the order dated 07.06.2018 (Annexure P-5) passed by respondent No.2.

This Court vide order dated 01.12.2023 had directed the Kanungo to be present in person in Court and status report be filed. Mr. Rakesh Kumar, Kanungo is present in person in Court today and filed the status report by way of affidavit of Inder Singh, Naib Tehsildar/Assistant Collector IInd Grade Tehsil Gharaunda, District Karnal.
It has been submitted by learned counsel for the State that the partition proceedings are at the final stage and now the next date for issuing the Sanad Taksim is 04.01.2024.
In view of the submissions made by learned State counsel, it is apparent that the partition proceedings are at the fag end. Let the parties appear before the authorities concerned and the same would be proceeded in accordance with law.
In view of the above position, the present petition is disposed of. However, the petitioner would be at liberty to pursue his remedy in case any further cause of action arises.
