***** RAJ MOHAN SINGH, J .(Oral) The petitioner seeks grant of anticipatory bail in case bearing FIR No.85 dated 26.06.2019, registered under Sections 406 and 420 IPC at Police Station Amloh, District Fatehgarh Sahib (Punjab).

At the time of issuance on notice of motion on 09.12.2019, the following order was passed:- "Petitioner prays for grant of pre-arrest bail in a criminal case arising out from FIR No. 85, dated 26.06.2019, registered under Sections 406/420 IPC, at Police Station Amloh, District

-2Fatehgarh Sahib (Punjab).

Learned counsel for the petitioner contends that the first informant is a retired police official and a civil dispute is sought to be converted into a criminal case. He further submits that the dispute between the parties arises out from the agreement to sell.

Notice of motion for 20.01.2020.

On asking of the Court, Mr.SPS Tinna, Addl.A.G.,Punjab, accepts notice on behalf of the State. A copy of the petition be handed over to Mr.SPS Tinna, Addl.A.G.,Punjab, during the course of the day.

In the meantime, in the event of arrest, the petitioner shall be released on interim bail subject to furnishing personal bonds and surety to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join the investigation as and when called upon to do so and shall abide by the conditions as provided under Section 438(2) Cr.P.C."

Learned State counsel on instructions from SI Major Singh states that the petitioner has joined the investigation though the recovery of amount is still to be effected. Keeping in view the background in which the FIR came to be registered, I deem it appropriate to confirm the order dated 09.12.2019, however petitioner shall keep on joining the investigation as and when required to do so and shall also abide

-3by the conditions as envisaged under Section 438(2) Cr.P.C. Petition stands disposed of.
