Nisha Kumari v. Aashika Jain, Ias
IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH
COCP-4751-2025 (O&M) Date of Decision : 17.02.2026 Nisha Kumari ... Petitioner
Versus
Aashika Jain, IAS ... Respondent CORAM : HON'BLE MRS. JUSTICE ALKA SARIN Present :
Mr. Malhar Singh Dhami, Advocate for the petitioner. Mr. Rohit Ahuja, DAG Punjab.
ALKA SARIN, J. (Oral) 1.
This is a petition under Section 12 of the Contempt of Courts Act, 1971 for initiation of proceedings against the respondent for violation of the order dated 02.09.2024 passed in CWP-11954-2019. 2.
Pursuant to order dated 02.02.2026, the respondent is present in Court.
3.
The issue raised in the writ petition (CWP-11954-2019) was that there was no mandate for getting the adoption deed specifically registered. Vide order dated 02.09.2024 the aforesaid writ petition was disposed off in terms of the judgment in CWP-14823-2008 [Sanjeev Kumar vs. State of Punjab & Ors. decided on 13.01.2010]. Thereafter, present contempt petition has been filed stating that the family pension would have to be paid to the petitioner from the date of death of the father of the petitioner i.e. 01.01.2008. It has further been averred that instructions dated 28.12.2012 JITENDER KUMAR 2026.02.18 10:04 I attest to the accuracy and integrity of this document Chandigarh
COCP-4751-2025 -2were in continuation of instructions dated 06.09.2000 and therefore the unmarried daughter i.e. petitioner would be entitled to the pension from the date of death of her father. This issue was not a subject matter of the writ petition as the only issue in the writ petition was whether the adoption deed was to be registered. The judgment in case of Sanjeev Kumar (supra) also only deals with the issue of an adoption deed for the release of Death-cumRetirement Gratuity. A whole new issue is sought to be raised by the petitioner in the present petition, which is beyond the scope of contempt jurisdiction. 4.
In view of the above, the present contempt petition is dismissed. Pending applications, if any, also stand disposed off.
