The present petition has been filed under Section 438 Cr.P.C. seeking grant of anticipatory bail to the petitioner in case FIR No. 15 dated 19.02.2023, under Sections 22, 29 of NDPS Act, registered at Police Station Sadar Batala, Police District Batala, District Gurdaspur. 2.
Learned counsel for the petitioner submits that the petitioner has been nominated on the disclosure statement of the accused Lakhbir Singh @ Sandy to the effect that the said contraband was purchased from the petitioner. Accordingly, the petitioner was nominated under Section 29 of NDPS Act.

Learned State counsel submits that there is cogent evidence against the petitioner and there are three more cases pending against the petitioner, two under Punjab Excise Act and one under NDPS Act. PARUL 2023.11.28 16:54 I attest to the accuracy and authenticity of this document

In light of the fact, that commercial quantity is involved and the petitioner is not having clean antecedents coupled with the fact that the investigation is still at an initial stage, I do not find any reason to grant the extra ordinary concession of anticipatory bail to the petitioner. 5.
