This petition has been filed under Section 482 of BNSS, 2023, seeking anticipatory bail in case FIR No.138 dated 09.09.2024 registered under Sections 21(C), 25/29 of NDPS Act, 1985, at Police Station Special Task Force, District SAS Nagar (mentioned as Police Station City Tarn Taran in order dated 21.10.2024, passed by Judge, Special Court, Tarn Taran) 2.

On 31.10.2024, the following order was passed:- "XX XX XX XX Learned counsel for the petitioner contends that the petitioner was initially not named in the FIR and has been nominated as an accused in the present case on the basis of the disclosure statement suffered by co-accused in the police custody. He further contends that except the disclosure statement suffered by the main accused in police custody, there is no other evidence against him. CRM-M No.54730 of 2024 petitioner is not involved in any other criminal case. Notice of motion.

On the asking of Court, Mr. I.P.S. Sabharwal, DAG, Punjab, accepts notice on behalf of the respondent-State. List on 26.11.2024.

In the meantime, the petitioner is directed to join the investigation. In the event of arrest, he shall be released on interim bail to the satisfaction of arresting/investigating officer subject to the conditions envisaged under Section 482 (2) of BNSS."

Learned State counsel has filed short reply by way of affidavit of Ravisher Singh, Deputy Superintendent of Police, Anti Narcotics Task Force, Border Range, District Amritsar, today in the Court which it taken on record and on instructions from SI Baljinder Singh, at the very outset, informs the Court that the petitioner has joined the investigation and his custodial interrogation is not required. 4.

In view of the statement of learned State counsel, order dated 31.10.2024 is hereby made absolute. The petitioner shall abide by the terms and conditions envisaged under Section 482(2) of BNSS (erstwhile Section 438(2) of the Code of Criminal Procedure, 1973). 5.

The petition stands disposed of.
