(Oral) Present petition has been directed against the order dated 25th July, 2017, passed by the Additional District Judge, Tarn Taran, whereby, petition under Section 13-B of the Hindu Marriage Act, 1955 (fore brevity 'the Act') was dismissed, as petitioner No.2 - Deepti Sharma refused to make her statement in terms of the settlement at second motion stage. Instant appeal was thus preferred by the appellant-husband.

Court has been informed that the parties have again settled the matter. Mr. Sharma, counsel for the appellant, thus, submits that he may be allowed to withdraw the instant appeal with liberty to file a fresh petition under Section 13-B of the Act, before the competent court of law. Dismissed as withdrawn with liberty as aforesaid. It is made clear that parties shall be at liberty to seek waiver off the statutory period of six months in terms of the judgment of the Apex Court rendered in Amardeep Singh Vs. Harveen Kaur, 2017(4) R.C.R. (Civil) 608.
