As observed in the previous order, none had made appearance on behalf of respondent No.1. Even today, none has made appearance on behalf of respondent No.1. As such, respondent No.1 is proceeded against ex-parte.

The applicant-wife has filed the present application for seeking transfer of the petition under Section 13 of the Hindu Marriage Act i.e. DMC-194-2023, titled 'Kamal Ranjit Singh Vs. Amandeep Kaur and another', filed by the respondent-husband, pending in the Family Court, Bathinda and she seeks transfer of the same to the Court of competent
TA-1205-2025 -2jurisdiction at Moga At the very outset, counsel for the applicant submits that marriage between the parties to the lis had taken place on 15.10.2014 and two sons were born from the said wedlock, who are in the age group of 5-7 years and are in the care and custody of the applicant, who herself, is not having any source of earning and is dependent upon her parental family. She has filed petition under Section 125 Cr.P.C., which is pending in the Courts at Moga and the respondent is making appearance in the same. Besides the aforesaid, the respondent had also filed petition under the Guardian and Wards Act, to seek custody of the children, which is also pending in the Courts at Moga. The distance between the two places is stated to be 80 kms.
Considering the submissions aforesaid, more particularly, about the applicant, who herself is not having source of earning, to be taking care of two minor children and also the fact of other litigations, more particularly, one initiated at the instance of the respondent, to be already pending in the Courts at Moga as well as distance between the two places and above it, considering the fact of respondent, not having come forward to resist the application, as such, the transfer application, as such, is hereby accepted and the petition under Section 13 of the Hindu Marriage Act i.e. DMC-194-2023, titled 'Kamal Ranjit Singh Vs. Amandeep Kaur and another', filed by the respondent-husband, stands transferred from the Family Court, Bathinda, to the Court of competent jurisdiction at Moga. The requisite record of the aforesaid case be sent by the Family Court, Bathinda, to the District and Sessions Judge, Moga.
TA-1205-2025 -3Learned District and Sessions Judge, Moga, shall assign the said petition to the Family Court, Moga. Even, the parties are directed to appear before the Family Court, Moga, within a period of one month from today onwards.
