***** VIKAS BAHL, J (ORAL) This is a civil writ petition filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus directing respondents No.1 to 3 to take appropriate action against respondents No.4 and 5 in view of the inquiry report dated 28.07.2017 (Annexure P-2).
Learned State counsel has submitted that in pursuance of the inquiry report dated 28.07.2017, respondent No.1 vide letter dated 08.06.2018 has decided to take action against respondent No.4 under Rule 7 of the Haryana Civil Services Rules 1987 and thereafter, in compliance of DINESH BANSAL 2023.03.23 10:29 I attest to the accuracy of this order Chandigarh the said letter, charge-sheet etc. has been sent to the Government vide
CWP-9302-2018 -22023:PHHC:041840 letter dated 29.11.2018 and thus, action has been taken against respondent No.4. It is submitted that as far respondent No.5 is concerned, after due consideration, no embezzlement has been found to have been committed by respondent No.5 and thus, no action under Section 51 of the Haryana Panchayati Raj Act, 1994, has been taken against him. Learned State counsel has submitted that in view of the same, the present petition has become infructuous.
Learned counsel for the petitioner has submitted that in view of the statement made by learned State counsel, the present petition has become infructuous and the same be disposed of as such. In view of the above, the present petition is disposed of as having been rendered infructuous.
