CR No. 6649 of 2025
IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH
CR-6649-2025 (O&M) Decided on : 19.09.2025 Smt. Santosh ......Petitioner
Versus
Smt. Raj Kala & Ors.
......Respondents CORAM :
HON'BLE MR. JUSTICE DEEPAK GUPTA
Present:
Mr. Abhimanyu Singh, Advocate, for the petitioner.
DEEPAK GUPTA, J.
Petitioner herein is defendant No.1 in Civil Suit No. 337 of 2020 titled 'Raj Kala Vs. Smt. Santosh & Ors.' pending before learned Civil Judge (Jr. Divn.), Bhiwani. By way of this petition filed under Article 227 of the Constitution of India, she has assailed order dated 12.03.2025 (Annexure P29), whereby her defence has been struck off. 2.
As the perusal of the paper-book would reveal that in the suit for declaration filed by the plaintiff (respondent herein) way back in February, 2020, appearance on behalf of defendant No.1 was made for the first time before the trial Court on 04.03.2020 through her Advocate, as evident from Annexure P-2. During 04.03.2020 to 12.03.2025, numerous opportunities were provided to the petitioner to file the written statement, but she failed to do so.
3.
As conceded by learned counsel for the petitioner himself, as many as 17 effective opportunities were availed by the petitioner to file the written statement during the period of more than 05 years, despite which petitioner could not file same.

CR No. 6649 of 2025 4.
In the aforesaid facts and circumstances, this Court does not find any justification for granting one more opportunity to the petitioner as is prayed for by learned counsel for the petitioner. 5.
There is no illegality or perversity in the impugned order. As such, finding no merit in the instant revision petition, the same stands dismissed.
