The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent No. 3 to impound passport of respondent No. 5.

Learned counsel for the petitioner inter alia contends that petitioner has lodged FIR No. 422 dated 15.09.2020, under Sections 498-A, 506, 34 of IPC, at Police Station, Purani Sabzi Mandi, Rohtak, against respondent No. 5 who is estranged husband of the petitioner. The respondent No. 5 was granted anticipatory bail vide order dated 15.10.2020 passed by Additional Sessions Judge, Rohtak. The respondent No. 5 without seeking permission from the trial court travelled abroad and he has come PARAMJIT KAUR SAINI 2023.11.23 16:59 I attest to the accuracy and authenticity of this order/judgment

CWP No.26351 of 2023 -2- 2023:PHHC:149246 back to India, however, there is apprehension that respondent No. 5 may flee from country.

It is conceded fact that police after completing investigation has filed report under Section 173 Cr.P.C. against respondent No. 5. The trial court is seized of the matter. In case of misuse of concession of bail, the trial court is quite competent to take an appropriate action. This Court, at this stage, does not find it appropriate to direct passport authority to impound passport of the respondent No. 5. The petitioner may approach trial court for the redressal of her grievance.
