The present petition has been filed inter alia challenging the order dated 17.03.2023 passed by learned Sessions Judge Ludhiana (Annexure P-3), whereby the bail bonds of the petitioner were cancelled due to his non-appearance. Subsequently, non-bailable warrants were issued.

Learned counsel for the petitioner submits that the nonbailable warrants were not executed and the petitioner absented from the proceedings due to miscommunication with his counsel and misconception about the date of hearing.

He submits that the petitioner has been regularly attending the trial since 08.08.2017 when he was granted the concessions of bail by the Court.

After hearing learned counsel for the petitioner, this Court is of the view that issuance of notice of motion shall only procrastinate the trial which has been pending since long.

In light of the above, the interest of justice would be met if the petitioner is subjected to put some cost.

Accordingly, order dated 17.03.2023 is set aside and the petitioner is directed to join the proceedings on or before the 29.11.2023 and the trial Court shall proceed after granting a bail to the petitioner on submissions of his fresh bail bonds to the satisfaction of the trial Court/Duty Magistrate, concerned. The petitioner shall also deposit cost of Rs.10,000/- which shall be deposited with Punjab and Haryana Court Bar Clerks Association.
