This petition has been filed for setting aside order dated 21.09.2018 passed by the learned Rent Controller, Ludhiana whereby evidence of the petitioner has been closed by order.

It is submitted that the petitioner-tenant seeks one more opportunity to conclude his evidence on the ground that grave prejudice shall be caused to the petitioner and he will suffer an irreparable loss in case an opportunity to lead his evidence is not permitted. CR No.6657 of 2018(O&M) [2] examined. It is thus prayed that this petition be allowed. Learned counsel for the respondents, on instructions from respondent No.1 who is present in Court, submits that in order to ensure speedy disposal of his petition, the respondents have no objection in case the present petition is allowed and the petitioner is afforded two opportunities to conclude his evidence, though subject to cost.

Having heard learned counsel for the parties and keeping in view the facts and circumstances of the case as well as the specific stand taken by the respondents, this petition is allowed. Impugned order dated 21.09.2018 passed by the learned Rent Controller, Ludhiana is set aside with a direction to the learned Rent Controller that two effective opportunities be afforded to the petitioner to conclude his evidence, subject to deposit of `10,000/- as cost to be paid to the respondents.

It is made clear that no further opportunity shall be afforded to the petitioner for the said purpose.
