CWP No. 7765 of 2018 (O & M) -1In the High Court of Punjab and Haryana at Chandigarh CWP No. 7765 of 2018 (O & M) Date of Decision: 13.02.2019 Chhota ram and another .....Petitioners

Versus

State of Punjab and others .....Respondents CORAM: HON'BLE MR. JUSTICE A.B. CHAUDHARI HON'BLE MR. JUSTICE ANUPINDER SINGH GREWAL

Present:

Mr.S.S.Swaich, Advocate for the petitioners.

Mr. H. S. Sullar, DAG, Punjab.

Mr.Lovish Rattan, Advocate for Mr. C.L. Premy, Advocate for respondents No.6 to 11.

**** A.B. CHAUDHARI, J (ORAL) Heard learned counsel for the rival parties.

The grievance of the petitioner relating to the division of gram sabha of two i.e. Arnetu and Arnetu Khurd, has not been adjudicated upon by the Director of Rural Development though so required by the Division Bench decision of this Court in Punjab Pradesh Congress Committee's case (CWP-8290-2013).

In our opinion, it would be appropriate for the authority to abide by the said decision and pass a speaking order. If the petitioner is still aggrieved obviously he would have a remedy to approach this Court again and in that event this Court would have an advantage of the reasoned order. CWP No. 7765 of 2018 (O & M) -2We, therefore, dispose of the present petition and allow the petitioner to file a comprehensive representation to the authority within a period of 15 days from today. If such a representation is filed, the Director shall adjudicate the same within a period of six months, if necessary by hearing the parties concerned and pass a speaking order. (A.B.
