*** Amol Rattan Singh, J. (Oral) Crl. Misc. No.M-52835 of 2019 By this petition, filed under the provisions of Section 439 of the Cr.P.C., the petitioner seeks the concession of 'regular bail'. Learned counsel for the petitioner submits that the petitioner has been arraigned as an accused in the FIR in question not because he was named in the FIR, but upon an alleged disclosure statement made by the coaccused. That being so, with the petitioner having been in custody for the past 4 months, I consider it appropriate to admit the petitioner to bail during the pendency of the trial.
Consequently, this petition is allowed. The petitioner would be
-2enlarged on bail, upon his furnishing adequate bail and surety bonds to the satisfaction of the trial Court.
Crl. Misc. No.M-52717 of 2019 In this petition, learned counsel for the petitioner submits that the petitioner had only taken a lift from the person from whom the recovery of the contraband is stated to have been made (as per the case of the investigating agency), i.e. Amandeep Singh.
That being so, with the petitioner having been in custody for the past 4 1⁄2 months, with no other criminal case shown to be registered against him and the trial virtually still to commence, without making any comment on the actual merits of the case, for or against the petitioner, I consider it appropriate to admit the petitioner to bail during the pendency of the trial.
Consequently, this petition is allowed. The petitioner would be enlarged on bail, upon his furnishing adequate bail and surety bonds to the satisfaction of the trial Court.
