Despite the case having been called twice, the appellant has gone un-represented.

Perusal of file shows that on the last three dates also i.e. 30.07.2018, 01.02.2019 and 31.07.2019, none had appeared on behalf of appellant. Therefore, it can safely be presumed that the appellant or her counsel is not interested in pursuing the instant appeal. More so, learned counsel for respondent No. 1 by producing copy of order dated 15.10.2018, duly attested by him submits that the instant appeal has rendered infructuous, in view of final disposal of execution against the appellant.

In view of the above, instant appeal is dismissed on following two counts:- (i) as having been rendered infructuous; and (ii) for want of prosecution as well.
