The petitioner has approached this Court seeking grant of anticipatory bail in respect of a case registered vide FIR No.349 dated 11.9.2019 at Police Station Civil Lines, Jind under Section 174-A of Indian Penal Code. 2.

Reply by way of affidavit of Sh. Kaptan Singh, Deputy Superintendent of Police, Jind has been filed by learned State counsel today in Court, which is taken on record.

The petitioner had been declared a proclaimed offender in respect of a complaint pending against him for offence punishable under Section 138 of Negotiable Instruments Act. However, the petitioner has already appeared in the said proceedings of the trial under Section 138 of N.I. Act as would be evident from a copy of order dated 28.11.2019 (Annexure P-4). In view of the aforestated position, the present petition is accepted. In the event of arrest, the petitioner be released on bail subject to his furnishing personal bonds and surety bonds to the satisfaction of Arresting/Investigating Officer.
