Learned counsel for the petitioner submits that from the date, when the petitioner was allowed to join his duties in the year 2018, he has not been granted his salary so far, which is totally arbitrary and illegal. Learned counsel for the petitioner submits that the respondents are under obligation to release the salary of the petitioner for the period he has discharged his duties and hence, an appropriate direction to be issued to the respondents-department for the grant of the salary to the petitioner.

Learned counsel for the petitioner further submits that the petitioner has already raised the said grievance in the representation dated 23.08.2018 (Annexure P-6) and in the said representation also, the petitioner has restricted to his claim for the grant of salary for the period he has discharged his duties, but the same is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a direction is issued to the respondents to decide the same by passing an appropriate speaking order in a time bound manner. On asking of the Court, Mr. Harish Nain, AAG, Haryana accepts notice on behalf of respondents-State and submits that in case for any period, the petitioner has discharged his duties but has not been paid his salary for the said period, an appropriate speaking order will be passed within a period of eight weeks from the date of the receipt of certified copy of this order and in case, after the decision, the petitioner is found entitled for any benefit, the same will be extended to him within a further period of four weeks.

Learned counsel for the petitioners submits that keeping in view the statement of learned State counsel, the present petition may kindly be disposed of having been not pressed any further. 5.
