On 30.11.2023, a show cause notice was issued to the appellant as to "why the proceedings for contempt be not initiated against her for the reason of once again filing an appeal against the same judgment passed by the First Appellate Court which has already been dismissed in a separate appeal filed by the appellant?

In response to the aforesaid show cause notice, an affidavit of the appellant has been filed, wherein it has been stated that this appeal was filed by mistake and she through her counsel in the trial Court had requested for filing an appeal against the order dismissing the suit for non-prosecution. 3.

The learned counsel representing the appellant tenders an unconditional apology and undertakes to remain careful in future. The learned counsel further prays for permission to withdraw the present appeal 4.

Ordered accordingly.
