The present petition has been filed for directions to the respondents No.2 and 3 to withdraw investigation of the case in FIR No. 275 dated 26.08.2025, under Sections 3(5), 324(4) and 329(3) of BNS, lodged in Police Station Naraingarh, District Ambala.

Notice of motion to the respondents No.1 to 3 only. 3.

Since advance notice has already been served upon the State, Mr. Parveen Kumar Aggarwal, Additional Advocate General, Haryana, accepts notice on behalf of the respondents No.1 to 3, and waives service. 4.

The learned counsel for the petitioner submits that the petitioner is Chairman and Managing Director of SRM Group of Colleges. As per learned counsel for the petitioner, on 23.08.2025, 8/10 persons along with weapons forcibly entered into the property of petitioner and threatened the site manager and damaged the boundary wall. According to learned counsel for the petitioner, on filing a complaint with the police, the above-mentioned DEEPAK KUMAR BHARDWAJ 2025.09.19 16:02 I attest to the accuracy and integrity of this document FIR was registered.

It has been further submitted by learned counsel for the petitioner that the private respondent is claiming himself to be the owner of the land in dispute and got the orders for police protection for fencing and demarcation of the disputed land. According to learned counsel for the petitioner, the petitioner has filed representations dated 04.09.2025 and 09.09.2025 (Annexures P4 and P5), respectively, before the police authorities, but no action has been taken, as yet, on the above said representations. The learned counsel for the petitioner further submits that a direction for disposing of the representations dated 04.09.2025 and 09.09.2025 (Annexures P4 and P5), respectively, be given to the concerned police authorities, and that the instant petition be disposed of. 5.

Keeping in view the aforesaid facts, the present petition is hereby disposed of with a direction to the respondent No.3-Superintendent of Police, Ambala, to decide the representations dated 04.09.2025 and 09.09.2025 (Annexures P4 and P5), respectively, on its own merits, as per law, by passing a speaking order within a period of 15 days from the date of receipt of copy of this order.

It is, however, made clear that no finding with regard to merits of the allegations is being recorded vide instant order, and the police authorities shall be at liberty to take an independent decision with regard to contents of the representation.
