(Oral) In the present petition, the claim of the petitioner is for promotion from the post of Medical Officer to Senior Medical Officer, which has not been considered by the respondents on the ground that the respondents-department are in process of framing the rules for the department concerned.

Notice of motion.

On asking of the Court, Mr. Harish Nain, Assistant Advocate General, Haryana, accepts notice on behalf of respondents-State and on instructions form Dr. Sarvjeet Kaur, Senior Medical Officer, ESI, Directorate, submits that the promotion of the petitioners could not be effected as, the gradation list of the cadre in which the petitioners are working, was quashed by the Court so as to frame a fresh gradation list and the gradation list is being prepared and thereafter the process of effecting promotion of the petitioners will be undertaken and the promotion will be RIYA 2023.12.01 13:48 I attest to the accuracy and integrity of this document

CWP-26519 -2023 (O&M) 2023:PHHC:152344 made keeping in view the rules which will be in existence at the time of said consideration.

Learned counsel for the petitioners submits that respondents be directed to frame the fresh gradation list in a time bound manner so that petitioners do not suffer any prejudice.

Learned counsel for the respondents submits that the process of completing the gradation list will be done within a period of four months from today and thereafter, the process of making promotion of the petitioners will be initiated as per the rules which will be in existence on the day of consideration.

Learned counsel for the petitioner submits that keeping in view the statement made by learned State counsel recorded herein above, the present petition may kindly be disposed of having been not pressed any further.
