The prayer in the present Civil Writ Petition filed under Articles 226/227 of the Constitution of India, is for directing respondent Nos. 1 to 4 to promote the petitioner as Senior Assistant w.e.f 01.10.2013 in the Physically handicapped category.

Learned State counsel submits that vide order dated 31.03.2016 (Annexure R-1), the petitioner was promoted as a Senior Assistant with immediate effect treating him as a candidate of General Category. However, he did not accept the same, whereafter, vide order dated 29.08.2019, he was again promoted as Senior Assistant w.e.f 01.10.2013 in the category of physically handicapped but again he did not accept it. As per Rule 18 of the Punjab Civil Services (General and Common Conditions of Services) Rules, 1994, the petitioner was debarred from consideration for promotion for a period of two years, vide order dated 09.12.2019 (Annexure R-3). CWP No. 14522-2018 2024:PHHC:038557 he has now been again promoted to the post of Senior Assistant w.e.f 06.10.2023 vide order dated 13.02.2024 but he refused to accept the same by sending a letter dated 23.02.2024 to the concerned school Principal, as informed vide letter dated 11.03.2024.

No one had put in appearance on behalf of the petitioner on the last two dates of hearing and the position remains the same even today, despite the case having been called out thrice. 4.
