This is a contempt petition filed under Section 12 of the Contempt of Courts Act, 1971 against respondents for violating the direction issued vide order dated 17.08.2023 (Annexure P-1) in CWP-13870-2021. 2.

Learned counsel appearing for the State has submitted that the Coordinate Bench had in fact directed the respondents to give effect to the memo/order dated 22.10.2021 and the benefits were also to be released 'in terms thereof'. It is submitted that along with the memo/order dated 22.10.2021 (Annexure P-2), there was a list of persons who were to be granted the benefits and the petitioner was shown at serial No.92 and against the name of the petitioner, it was specifically stated that the petitioner has been made eligible for the scale of Rs.4100-5300 w.e.f. 22.01.1995 (notionally). It is submitted that the said term 'notionally' has not been used for a large number of persons in the list annexed at page no.14 of the paperbook. COCP-3617-2023 2 circumstances, the actual arrears of pay are not to be paid to the petitioner. 3.

Learned counsel for the petitioner has submitted that in view of the same, present revision petition be dismissed as withdrawn with liberty to the petitioner to seek appropriate remedy in accordance with law. 4.

Keeping in view the above said facts and circumstances, present petition is dismissed as withdrawn with the liberty aforesaid. 5.
