Petitioner Anand Kumar has filed instant petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail in FIR No.0290 dated 11.12.2024 under Sections 316 (2), 318 (4) of Bharatiya Nyaya Sanhita, 2023 (Sections 338, 336 (3), 340 (2), 61 (2), 111 (1) (iii), 3 (5) of Bharatiya Nyaya Sanhita, 2023 added later-on) registered at Police Station Udyog Vihar, District Gurugram. 2.
Brief facts of the case are that on the complaint of Neeraj Kumar Sharma, present FIR has been registered for committing fraud while travel booking by Farefuels Holiday Private Limited. Complainant stated that he along with his wife had gone to the office of Farefuels Holiday Private Limited for their travel booking for going to Thailand. They had deposited Rs.60,000/- through debit card of his wife and Rs.90,000/- through UPI by the complainant and had further deposited
-2Rs.1.5 lacs in their office. Later-on, they gave him dummy tickets. When they checked with the airline it was revealed that the same were cancelled automatically for not making payment to the airline. They came to know that one person Surya Kant Jha was also arrested in the year 2019 for similar travel frauds. He has mentioned the names of various persons with whom fraud was committed involving huge amounts. With these allegations, present FIR has been registered. 3.
Learned counsel for the petitioner argued that allegations levelled against him are without any basis. He was employee with Farefuels Holiday Private Limited. Offer letter dated 01.04.2024 is Annexure P-2. He joined the said concern. Later-on, when he realised the functioning of said concern he resigned vide letter dated 10.07.2024 (Annexure P-3) and his resignation was accepted with effect from July 10, 2024 vide communication dated 22.08.2024 (Annexure P-4). He was also aggrieved of Surya Kant Jha for cheating and criminal breach of trust regarding which he has filed a complaint on 10.03.2025 (Annexure P-6). It is pointed out that in pursuance of order dated 16.03.2026 petitioner has already joined investigation. He is still ready to cooperate with the investigating agency.

Status report filed taking the stand that Satya Kant Jha accused was arrested in this case and after completion of investigation, challan is already presented. Present petitioner along with other accused were required to join investigation and for this reason, process was issued by the Court. Learned counsel representing State conceded that present petitioner has already joined the investigation and now he is not required for further investigation.

Considering the aforesaid factual position, it is evident that petitioner has joined investigation and cooperated with the investigating agency. No purpose would be served by sending him behind the bars. Therefore, interim bail already granted in favour of the petitioner vide order dated 16.03.2026 stands confirmed subject to the conditions as envisaged under Section 482 (2) Bharatiya Nagarik Suraksha Sanhita, 2023.

Petition is accordingly accepted.
