***** RAJ MOHAN SINGH, J .(Oral) The petitioner seeks grant of anticipatory bail in case bearing FIR No.0082 dated 13.09.2019, registered under Section 420 and 34 of Indian Penal Code, 1860 at Police Station SGN Dev Thermal Plant, Bathinda.
Learned counsel for the petitioner submitted that in the FIR, the alleged allegations are of sending Bikramjit Singh son of the complainant abroad for a sum of Rs.12,50,000/-, whereas an amount of Rs.5,33,500/- was deposited by the complainant in
-2Paul Merchant Limited, Chandigarh. Further an amount of Rs.1,51,000/- was also deposited towards education fee with the Paul Merchant Limited, Chandigarh. Petitioner has nothing to do with the aforesaid Paul Merchant Limited, Chandigarh. In order to show his bona fide, the petitioner is ready to deposit the payments allegedly received by him with receipts and without receipts i.e. an amount of Rs.5,12,600/- with the Trial Court. Without prejudice to the rights of the parties, at this stage, let an amount of Rs.5,12,600/- be deposited by the petitioner within 15 days in the Trial Court. On doing so, the petitioner is directed to appear before the SHO/Investigating Officer to join investigation and in the event of his arrest, he shall be released on bail on his furnishing bail bonds to the satisfaction of SHO/Investigating Agency subject to the following conditions as envisaged under Section 438(2) Cr.P.C:- i) that the petitioner shall make himself available for interrogation before the Investigating Officer as and when required;
ii) that the petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer;
iii) that the petitioner shall not leave the country,
-3without prior permission of the Court and shall surrender his passport, if any.
In view of above directions, this petition stands disposed of.
