The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to issue his passport.

Learned counsel for the petitioner inter alia contends that petitioner was holding passport which was valid upto 2004. An FIR No. 14 dated 12.01.2009, under Section 15 of the NDPS Act came to be registered against the petitioner at Police Station, Sadar Abohar. The petitioner vide judgment dated 28.01.2014 came to be convicted and was awarded sentence of 10 years vide order dated 31.01.2014. The petitioner has preferred CRAS- 435-SB of 2017 before this Court. The sentence of the petitioner has PARAMJIT KAUR SAINI 2023.12.07 17:26 I attest to the accuracy and authenticity of this order/judgment

CWP No.26500 of 2023 -2- 2023:PHHC:156131 been suspended vide order dated 07.03.2018. The case of the petitioner is squarely covered byjudgment of this Court in Mohan Lal @ Mohna vs. Union of India and others 2023 SCC Online P&H 1391. 3.

Learned counsel for Union of India states that petitioner has been issued show cause notice and he may be directed to appear before passport authority alongwith requisite documents. On doing so, passport authority would pass an appropriate order considering the afore-mentioned judgment, within six weeks.

Learned counsel for the petitioner agrees to the aforesaid arrangement.

In view of statements of both sides, the petition stands disposed of with a direction to petitioner to appear before the passport authority on 19.12.2023 alongwith requisite documents.
