Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner(s) in case FIR No. 97 dated 27.09.2017, registered under Section(s) 15/25/61/85 of the Narcotic Drugs & Psychotropic Substances Act, 1985 at Police Station Mehna, District Moga. Learned counsel for the petitioner contended that petitioner was not named in the FIR; nothing was recovered from him and he has been falsely implicated in the case. More so, petitioner has joined the investigation as per directions issued by this Court vide order dated 22.02.2018.

Learned counsel for the respondent, on instructions from Ramesh Kumar, Assistant Sub Inspector, affirmed the fact that petitioner has joined the investigation, but opposed the prayer for granting him the DEEPAK KUMAR BHARDWAJ 2019.03.26 15:07 I attest to the accuracy and integrity of this document

Criminal Misc. No. M-7571 of 2018 concession of pre-arrest bail on the ground that consignment was addressed to the present petitioner.

Having considered the submissions made by learned counsel for the parties and taking into consideration the allegations levelled against the petitioner in the FIR, the present petition is accepted and order dated 22.02.2018, passed by this Court, granting interim pre-arrest bail to the petitioner(s), is made absolute.
