Sandhu, Advocate, for the petitioner **** RAJ MOHAN SINGH, J.(Oral) Petitioner has approached this Court for issuance of direction to respondents No.1 to 3 to conduct fair and impartial investigation of the case bearing FIR No.30 dated 19.1.2003 registered under Sections 379, 420 and 411 of Indian Penal Code at Police Station Dhuri, District Sangrur and also to lodge an FIR against respondents No.4 to 7 under the relevant provisions of law.

It is not in dispute that after registration of FIR, the petitioner has been convicted and sentenced by the Trial Court after full fledged trial. He remained unsuccessful in the appeal before the Lower Appellate Court and Criminal Revision No.2301 of 2009 titled 'Shingara Singh Vs. State of Punjab' is pending in the High Court.

CRM-M No.52948 of 2019 (O&M) In view of aforesaid factual position, no such direction to conduct fair and impartial investigation can be issued. On the basis of investigation done by the police, the challan was presented.

After framing charges, the petitioner was convicted by the Courts below. Even, the petitioner has not filed any application for further investigation at any point of time. Now there is no scope to entertain the prayer of the petitioner as the same is intended to seek nullification of judgment of conviction and order of sentence passed by the Courts below particularly when his revision petition against the conviction is pending in the High Court.
