MANJARI NEHRU KAUL, J. (ORAL) Petitioner is seeking the concession of anticipatory bail under Section 438 of the Cr.P.C. in case FIR No.125 dated 27.09.2019 under Sections 420/120-B of the Indian Penal Code, 1860, and Section 13 of Punjab Travel Professional Act, 2014, registered at Police Station Majitha Road, District Amritsar.

Learned counsel for the petitioner has very fairly submitted that the petitioner was unable to comply with the order dated 24.11.2023, wherein he had been directed to join investigation as it was a matter of record that the medical condition of petitioner's wife was critical and she was completely bedridden. He submits that a compassionate view be taken since the matter already stands amicably settled between the parties and even the amount in the sum of `33,55,000/- stands handed over to the complainant. Learned counsel for respondent No.2/complainant has not disputed the submissions made by the counsel opposite. She also does not oppose the prayer made by the learned counsel for the petitioner for making the order dated 24.11.2023 absolute.

In view of the above, the petition is allowed and interim order dated 24.11.2023, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C.
