**** HARNARESH SINGH GILL , J. (ORAL) The petitioner is seeking regular bail in FIR No. 90 dated 23.1.2019 under Sections 302, 34, 120-B IPC and Section 25 of the Arms Act registered at Police Station Shivajit Nagar, District Gurugram. Learned counsel for the petitioner submits that petitioner is in custody since 25.4.2019. He further states that the petitioner has been involved in the present case on the basis of disclosure statement suffered by co-accused Pawan @ Kali. The petitioner was not named in the FIR and no role has been attributed to him. Even in his statement recorded under Section 161 Cr.P.C., Pawan @ Kali has stated that the petitioner was accompanying him on the Activa while doing recce. Learned State counsel, on instructions from Sub Inspector Paramjit Singh, submits that from the disclosure statement of co-accused, it was found that the petitioner was also present at the place of occurrence. CRM-M No. 53348 of 2019 -2The petitioner is in custody since 25.4.2019. The trial will take time to conclude. No useful purpose would be served by keeping the petitioner behind the bars.

Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
