On 20.12.2019, when the petition was listed for the first time, notice of motion was issued by the co-ordinate Bench of this Court and the parties were directed to appear before the Ilaqa Magistrate/trial Court for recording of their respective statements before the trial Court with regard to the compromise/settlement on 31.01.2020.

2.1 Thereafter, the case was listed on 18.04.2022 and it has been noticed by the co-ordinate Bench of this Court that though the petitioners had appeared but the complainant did not appear to get her statement recorded, as per the report received from the trial Court. On that date, there was no

-2representation on behalf of respondent No. 2 and therefore, in the interest of justice, the case was adjourned for 18.05.2022. 2.2 On 18.05.2022 both counsel for the parties were present but on request of learned counsel for the petitioners, the matter was adjourned for 10.08.2022. On that date, the turn of the case could not come up and the matter was adjourned for 17.01.2023 "by order". 2.3 On 17.01.2023 Mr. Dimple Garg, Advocate, appeared on behalf of respondent No. 2 and filed his Vakalatnama and the matter was adjourned for 17.02.2023. On that date, neither there was any representation on behalf of the petitioner nor on behalf of respondent No. 2 and the matter was adjourned for 09.03.2023. On that date again the turn of the case could not come up and the matter was again adjourned for 18.05.2023 "by order". 2.

4 However, in the meantime, on 16.05.2023 CRM-21565-2023 was filed on behalf of respondent No. 2-complainant with a request for issuance of directions for recording of her statement. The said CRM was ordered to be listed along with the main case which was already fixed for 18.05.2023.

2.5 On 18.05.2023 there was no representation on behalf of the petitioners, as well as, respondent No. 2-complainant and again the matter was adjourned for 03.08.2023. On that date, again there was no representation on behalf of the petitioner and the case was adjourned for 07.12.2023. On that date again the turn of the case could not come up and the matter was adjourned for 22.01.2024 "by order". On that date, again no one present on behalf of the parties and the matter was adjourned for 04.03.2024.

-3On 04.03.2024 again the turn of the case could not come up and the case was again adjourned for 09.04.2024, i.e. today.

Today again no one has in appearance on behalf of counsel for the petitioners, as well as respondent No. 2. 4.

Keeping in view the observations made hereinabove, it seems that the petitioners are not interested in pursuing the present petition. 5.

Consequently, the present petition stands dismissed for nonprosecution. 6.

Pending miscellaneous application (s), if any, shall also stand disposed of.
