This is the first petition filed under Section 439 Cr.P.C. for grant of regular bail in case FIR No.437 dated 13.06.2023, under Sections 147, 149, 323, 325, 307, 365, 379-B, 427, 506, 120-B of IPC, 1860 and Section 25 of Arms Act, registered at Police Station Surajkund, Faridabad, Haryana. 2.

At the outset, learned counsel for the petitioners submits that coaccused Deepak and Jaihind @ Jaihind Bhadana, who were specifically named in the FIR, have already been allowed regular bail by this Court vide order dated 29.11.2023 passed in CRM-M-53614-2023 and CRM-M-53714-2023, copy of which has been placed on record. It is contended by learned counsel for the petitioners that the petitioners are on better footings inasmuch as petitioners are not even named in the present FIR. 3.

Learned State counsel has not refuted the aforesaid contention. 4.

Having regard to the aforesaid factual position, but without commenting anything upon the merits of the case, and that the co-accused have already been granted the concession of regular bail by this Court, the petitioners also deserve the same relief on grounds of parity. 6.

Considering all the aforesaid facts and circumstances of the case, the petitioners are admitted to bail. They are ordered to be released on bail on their furnishing requisite bail bonds and surety bonds to the satisfaction of learned Trial Court/Duty Magistrate concerned. 7.

Allowed.
