SUVIR SEHGAL, J. (Oral) The petitioner is seeking regular bail in FIR No.191 dated 01.05.2016 under Sections 148, 149, 180, 323, 302, 506, 427 and 120-B of Indian Penal Code and Section 25 of Arms Act, 1959 registered at Police Station Pehowa, District Kurukshetra.

Learned counsel for the petitioner has contended that though the petitioner is named in FIR but there is no specific attribution qua him. He has further submitted that the petitioner is in custody since 31.01.2019. On instructions from ASI Dharampal, learned State counsel has submitted that prosecution evidence is underway and 50 witnesses, including the material witnesses, out of total 64 prosecution witnesses have SAVITA KADIAN 2020.01.09 17:01 I attest to the accuracy and integrity of this document High Court Chandigarh

CRM-M-53681 of 2019 {2} been examined. He has further submitted that main accused Manjeet Singh Alias Maan Singh and the co-accused Lakhwinder Singh have been granted regular bail by the Additional Sessions Judge as well as by this Court, vide orders dated 06.06.2018 (Annexure P-14) and 14.05.2018 (Annexure P-18) respectively.

Since the petitioner is in custody for the last more than 11 months and trial is likely to take time, no useful purpose would be served by keeping the petitioner behind the bars.

Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
