Present petition has been filed under Article 226/227 of the Constitution of India for issuance of a writ in the nature of Habeas Corpus for directing the respondents to produce detenue namely Husan Bibi i.e. daughter of the petitioner before this Court and her custody be handed over to the petitioner who has been illegally confined by respondents No.5 to 10 in FIR No.0087 dated 29.07.2025, under Sections 137(2), 87, 115(2) and 117(2) of BNS, 2023, registered at Police Station Purana Shalla, District Gurdaspur, 2.

Learned counsel for the petitioner contended that the petitioner's daughter has been taken away by some people and regarding this, he has lodged a complaint and an FIR has been registered but the police has not investigated the matter properly and now the petitioner has apprehension that her child is in illegal custody of respondents No.5 to 10. 3.

As an FIR has already been registered in this matter, so this Court finds no merit in the petition for issuing any direction, however, the petitioner is at liberty to move representation before respondent No.3-Senior Superintendent of Police, Gurdaspur and he is directed to look into the averments/ allegations in accordance with law. 5.
