***** ARCHANA PURI, J. (Oral) As observed in the order dated 26.11.2025, despite service, the respondent did not make appearance, on that date. Thereafter, on the subsequent date, he has not made appearance. Today also, none has made appearance on his behalf. As such, respondent is proceeded against ex parte. Counsel for the applicant heard.

The applicant-wife has filed the present application for seeking transfer of the petition under Section 13 of the Hindu Marriage Act i.e. HMA/361/2024 titled 'Sohar Lal v/s Yogita, filed by the respondenthusband, pending in the Family Court, Narnaul and she seeks transfer of the same to the Court of competent jurisdiction at Jhajjar. At the very outset, it is submitted by the counsel for the applicant that the marriage between the parties to the lis, had taken place on 15.05.2024, but no child was born from the said wedlock. On account of matrimonial dispute, the parties are residing separate. The applicant is not having any source of earning and is dependent upon her parental family. TA-1217-2025 has filed one compliant under Section 12 of Protection of Women from Domestic Violence Act as well as the maintenance petition, which are pending in the courts at Jhajjar. Also, the respondent is facing trial in a criminal case, in the courts at Jhajjar. The distance between the two places is stated to be 105 kms.

Keeping in view the submissions aforesaid, more particularly, considering the fact of the applicant having no source of earning and three other litigation arising from the broken marriage, to be already pending in the courts at Jhajjar and more particularly, the criminal case, wherein the respondent is required to make appearance on each and every date of hearing as well as considering the fact of respondent having not come forward to resist the transfer application, the same is allowed and the petition under Section 13 of the Hindu Marriage Act i.e. HMA/361/2024 titled 'Sohan Lal v/s Yogita, filed by the respondent-husband, stands transferred from the Family Court, Narnaul, to the Court of competent jurisdiction at Jhajjar. The requisite record of the aforesaid case be sent by the Family Court, Narnaul, to the District and Sessions Judge, Jhajjar.

Learned District and Sessions Judge, Jhajjar, shall assign the said petition to the Family Court, Jhajjar. Even, the parties are directed to appear before the Family Court, Jhajjar, within a period of one month from today onwards.
